The Gold Standard

Martindale Hubbell shares its list of local lawyers

More than 1,200 of the Top Rated Attorneys in Birmingham from Martindale Hubbell’s AV Rated Lawyers list.

To compile a list of top area lawyers, we invited LexisNexis® Martindale–Hubbell®, the organization that has long set the standard for lawyer ratings, to share their list of local lawyers who have reached the highest levels of ethical standards and professional excellence.

The law touches all of us in practically every aspect of our life. B-Metro felt it wuld be a great service to our readers to highlight the top attorneys in town as determined by their having reached AV-rated status with Martindale-Hubbell.

More than polls or popularity contests, we thought this was an appropriate way to present the region’s lawyers who have achieved a premier status in their profession.

An AV® certification mark is a significant rating accomplishment—a testament to the fact that a lawyer’s peers rank him or her at the highest level of professional excellence.

Martindale-Hubbell Peer Review Ratings reflect a combination of achieving a Very High General Ethical Standards rating and a Legal Ability numerical rating. A threshold number of responses are required in order to achieve a rating. For lawyers rated with the changed methodology the Martindale-Hubbell Peer Review Ratings reflects the following:

General Ethical Standards Rating

The General Ethical Standards rating denotes adherence to professional standards of conduct and ethics, reliability, diligence and other criteria relevant to the discharge of professional responsibilities.

Those lawyers who meet the “Very High” criteria of General Ethical Standards can proceed to the next step in the ratings process.

Legal Ability Ratings

For lawyers rated with the changed methodology, Legal Ability ratings will now indicate professional ability within a specific area of practice. Legal Ability ratings are based on performance in five key areas, rated on a scale of 1 to 5 (with 1 being the lowest and 5 being the highest). These areas are:

Legal Knowledge—Lawyer’s familiarity with the laws governing his/her specific area of practice(s)

Analytical Capabilities—Lawyer’s creativity in analyzing legal issues and applying technical knowledge

Judgment—Lawyer’s demonstration of the salient factors that drive the outcome of a given case or issue.

Communication Ability—Lawyer’s capability to communicate persuasively and credibly

Legal Experience— Lawyer’s degree of experience in his/her specific area of practice(s)

For more than 140 years, from the time lawyer and businessman James B. Martindale first published The Martindale Directory in 1868, Martindale-Hubbell® has been the gold standard of legal ratings companies. When Martindale started the directory, its stated purpose was “to furnish to lawyers, bankers, wholesale merchants, manufacturers, real estate agents, and all others…the address of one reliable law firm, one reliable bank, and one reliable real estate office in every city in the United States…”

By 1896, The Martindale Directory included the basic information that still appears in the company’s  lawyer and law firm profiles, as well as ratings and a section on foreign lawyers and firms.

In 1930, the Martindale Company purchased the publishing rights to Hubbell’s Legal Directory, which contained a digest of state laws, court calendars and a selective list of lawyers and firms. The following year marked the first edition of the Martindale-Hubbell Law Directory; a two volume set that combined the features of both predecessor publications.

Today, Martindale-Hubbell offers solutions for both professional and consumer markets. Its online destinations contain profiles for over one million lawyers and firms in the United States, Canada and 160 other countries, serving as a fundamental legal resource and marketing tool.

B-Metro’s Top Lawyers

About the list:

Generations of lawyers have relied on Martindale-Hubbell® as the authoritative resource for information on the worldwide legal profession. With a history spanning 140 years, the Martindale-Hubbell Legal Network is powered by a database of over one million lawyers and law firms in over 160 countries. Thousands of people use the network every day to find local attorneys, confirm their credentials and select firms that provide services for their personal and professional legal needs.

To create this list of Top Lawyers in the Birmingham area, LexisNexis® Martindale-Hubbell® tapped its comprehensive database of Martindale-Hubbell® Peer Review Ratings™ to identify lawyers who have been rated by their peers to be AV® Preeminent™ — the highest Peer Review Rating available.

Martindale-Hubbell Peer Review Ratings are driven by the confidential opinions of lawyers and members of the judiciary who receive invitations from LexisNexis Martindale-Hubbell, via an online survey or by mail, to provide reviews of lawyers of whom they have professional knowledge. Peer Review Rated lawyers are not required to have a paid listing on Lawyers.comSM or®. To learn more about Martindale-Hubbell Peer Review Ratings, please go to

Social Media is creating new questions

The Law of

Social Media

The new ways we communicate have brought plenty of legal issues to the conversation.

A new national survey reveals half of Americans who use social networking sites have seen people divulge too much personal information, yet more than a quarter of Americans (28 percent) who use these sites admit that they rarely think about what could happen if they share too much personal information online.

Additionally, more than four in ten Americans (44 percent) are concerned that the personal information they share online is being used against them, and more than one in five (21 percent) Americans who use social networking sites believe that their personal information has been accessed by people who take advantage of weak privacy settings on social networking sites.

The 2010 Social Networking Survey, as well as legal tips and resources on the risks associated with the use of social media, are available at – the leading legal website for consumers and small business owners. Conducted by TNS Global, the survey was commissioned by LexisNexis to better understand Americans’ attitudes and behaviors toward sharing personal information on social networks.

“The Social Networking Survey reveals a clear disconnect between the privacy concerns of users and their actual behaviors and disclosures on social networking sites,” said Carol Eversen, vice president of Marketing at LexisNexis. “Nearly every week we hear about the negative consequences resulting from inappropriate disclosures and uses of personal information on social networking sites, however the data suggests that Americans are not taking the necessary steps to protect themselves.”

Sharing Personal Information Online, How Much is Too Much?

More than half of Americans who use social networking sites have seen people divulge too much personal information online. In fact, the majority of Americans who use social networking sites admit that they have posted their first and last name (69 percent), photos of themselves (67 percent), or an email address (51 percent) on a social networking site. In addition, survey respondents have also shared the following details on a social networking site:

Travel plans (16 percent)

Cell phone numbers (7 percent)

Home address (4 percent)

Determining how much is too much is still a struggle for many people. Nearly half of Americans (46 percent) agree that sometimes it is hard to figure out what information to share and what to keep private.

Consequences of Sharing Personal Information Online

As many Americans struggle with what type of personal information to post online and keep private, they also seldom think about the consequences of sharing personal information online. More than a quarter of Americans (28 percent) admit they rarely think about what could happen if they shared too much personal information online.

A quarter of Americans (25 percent) who use social networking sites say that they have seen people “misrepresent” themselves (e.g., posted incorrect information and created fake profiles) and alarmingly, more than one in ten Americans (14 percent) who use social networking sites say that they have received communication from strangers as a result of sharing information on a social networking site.

Other backlash from using social networking sites includes:

Someone posting unflattering pictures of them (11 percent)

Having personal relationships with family or friends affected from revealing too much information (7 percent)

Being scolded or yelled at for information they’ve posted (6 percent)

Surprisingly, 38 percent of Americans agree that people who share too much of their personal information online deserve to have their information used inappropriately.

Privacy Concerns and Exploitation

Three-quarters of Americans (76 percent) worry that the privacy settings on social networking sites are not adequately protecting their personal information. In addition, more than four in ten Americans (43 percent) admit that they typically just click “agree” without reading the entire terms and conditions on social networking sites.

Meanwhile, many believe that their personal information may already be in the wrong hands. More than four in ten Americans (44 percent) are concerned that the personal information they share online is being used against them, and one in five Americans (21 percent) who use social networking sites believe that their personal information has been accessed by people who take advantage of weak privacy settings on social networking sites.

Career Risks

Four in ten Americans (40 percent) indicated it is all right for managers to monitor their employees’ personal tweets and Facebook pages, and the same percentage of Americans who use social networking sites believe that losing their job because of information they’ve posted on a social networking site could happen to them. Yet, more than half of Americans (53 percent) agree that inappropriate comments or posts on social networking sites should not affect someone’s employment.

what you post on social media sites:

One of the number one reasons to be careful what you post on social media websites is because of working. Whether it is about your current job or possible future jobs, the truth is, employers look at these sites. They want to know what their employees are doing or what potential employees do with their free time. Although this may not seem fair, there is really nothing you can do about it. Employees put a lot of stock in what they see on these sites. Even the most innocent of things can be taken as something harmful by the employer. You could possibly lose your job or not get the job that you have been hoping to get.

Everyone Sees It

Whatever you post on social media sites can be seen by anyone and everyone. That doesn’t sound so bad, but you would be surprised what can happen. Think very hard about what you post on social media sites if you don’t want everyone to know what you have been doing. In other words, don’t post every detail of your life on social media sites if you don’t want the world to know about it. No one needs to know that you are eating at a specific restaurant at a specific time in a specific town. You are giving far too much information that would allow any pervert in the world to easily find you.

It Can Be Hurtful

You can hurt other people by posting too much information on a social media website. You might be angry with someone or you might say something that you don’t mean to hurt someone. Those words can hurt much more than you think. Not everyone wants their lives put out for the entire world to see. Some people prefer to keep private matters private. However, that doesn’t stop others from putting the information out there. That is when it can cause big problems for you. If you want to post personal information, make it about yourself. Don’t bring others into it.

Friends and Family

If you don’t want your friends and family to see what you are posting on the internet, you shouldn’t post it. That is why you should be careful what you post on the internet. You might not think they will ever see it, but you can’t know that for sure. They could run across it and then you will have to answer for that. If you don’t want them to know, why would you put it on the most public forums available thanks to social media sites.

If you post it on the internet, you could be leaving yourself open for lawsuits or the information can be used in court. Remember, what you think of as an innocent post, could get you in big trouble. That includes with the law.

There are some things that you just shouldn’t post on social media sites. Let your social networking be about meeting new people. Leave out information that really doesn’t need to be made a worldwide issue. That is what you open yourself up to when you aren’t careful about what you post on the internet. Don’t learn your lesson the hard way like so many others before you have. •
