Benita Jenkins Washington is the owner and Attorney at the Law Of Benita Jenkins, LLC located in the heart of downtown Birmingham, Alabama.
Her main area of practice is Family Law. She is usually in Family Court or Domestic Relations Court fighting for parents custodial rights and other issues surrounding children.
Benita is an advocate for equal rights and representing her clients to the fullest extent of the law. She takes pride in helping those who wouldn’t have a voice without representation. In conjunction with her private and retained cases, she is an appointed attorney with Jefferson County’s family court and often gets to represent parents whom can not afford lawyers. Benita is also contracted with Legal Services of Alabama where she handles divorce cases involving children and/or domestic violence cases where the parents pay reduced attorneys fees or none at all.
Benita has been helping families be reunified and move toward a healthy future for almost 10 years. She’s been featured in B-Metro magazine as a top attorney in the area of Family Law for the last several years. She recently was a part of a legal defense team that represented a Judge charged with ethical violations before the Judicial Inquiry Commission in which the trial was held at the Supreme Court.

Q & A
Why did you first become interested in family law?
I have always liked helping others before I became a lawyer especially with figuring out tough decisions. When I first became a lawyer and started frequenting the family court, that’s where I felt the most fulfilled and felt like I was really helping people through some of the most difficult times of their lives. Although there are very long hours, and can be emotionally taxing, it really feels like I’m fulfilling my purpose in life when I help navigate parents getting custody of their children back, or helping parents when they are going through divorces by helping them come up with ways to still be in healthy co-parenting relationships with their soon to be ex spouse or in some instances helping parents protect themselves and their children from dangerous situations and/or people.
What do you think are the most important personal attributes you bring to the practice of family law?
I am a minority female in a male dominated field. I think that’s my biggest attribute honestly. There have been so many years of women, especially women of color, being underrepresented in the legal field. Most of the family court cases I have are with minority parents and children. I think that my clients relate to me because I look like them a lot of the time.
I am a blunt person by nature so that helps me to be naturally honest with my clients even if it goes against what they may want to hear. I try my best to take their situation and give them sound advice according to the laws and fact situations that they have.
I bring a “new-school” approach to family law cases. There is no “set in stone” custody schedule that every family goes by. I take each clients situation and I come up with an individualized plan of action for them so that they know we are a team. When I handle family law cases, I come up with strategies and allow my clients to give me the evidence that I need to prepare those strategies for any hearings or trials. I keep my clients interactive and hands on with their cases so that they are up to date on every legal step in their case.
