Practice Areas

Divorce, Custody and Visitation: Hiring the right attorney to advise you in your divorce process and bring your case to an efficient cost-effective resolution is the most important thing for you to feel represented and secure. The right attorney can make all the difference to your family after the divorce is finalized.

Property Division: A top issue during most divorces is how to divide property equitably between spouses, including high net worth investments, trusts and business interests..

Modifications: When an ex-spouse wishes to change certain conditions pertaining to their divorce decree, that is referred to as post-divorce actions or modifications. Modifications can be just as complicated as the initial divorce process.

Pre-Nuptial and Post-Nuptial Agreements: A marital contract can make all the difference in a divorce. Agreements relating to debts, accounts, and joint property allow you to set the stage for your marriage or after reconciling your marriage. These also allow you to streamline issues in the unfortunate event of a divorce.

Contempt: Divorce can be complicated and sometimes a divorce decree may be hard to maintain; but once a divorce decree is finalized and a court order is entered it is legally binding and must be upheld or the court may intervene through a contempt filing.

Q & A

What you should know about divorce ?

“At J Hardy Family Law, we know that marriages are tricky; and sometimes a marriage may end in divorce. Knowing what the laws are for your state, plus the requirements for filing, are critical tools your lawyer must know. In Alabama, there are criteria and guidelines to follow for a successful filing and entry of a divorce agreement or order. With divorce agreements, property division and rights relating to custody and the visitation of children are two of the most important issues covered. In Alabama, a divorce can be granted based on fault-grounds (adultery, abuse, etc.) or no-fault grounds, but either way, you have to wait the standard 30 days as a “cooling off” period from when the Complaint is filed to when the Court can legally enter a divorce decree, even if you and your spouse have a divorce agreement.”

What special talents and sensibilities do you need to bring to the practice of divorce law?

“I practice divorce law with an eye on the family dynamic which means I look to understand the “psychology of the family” before I take any legal action that may ultimately make my client’s family worse. I find that how you start the divorce process and who you hire says everything about how the divorce process will go for your case and how much or little the process will affect your family. Be intentional about your decision to hire a divorce attorney because your confidence and control over the process to protect your family should always come first.”
